§ 26 DSG NRW
Competence
(1)As supervisory authority, the State Commissioner for Data Protection and Freedom of Information shall supervise compliance with the data protection provisions within the scope of application of Regulation (EU) 2016/679, this Act and other legal provisions on data protection with respect to public bodies. For non-public bodies and those within the meaning of Section 5(5), he or she shall be the supervisory authority pursuant to Section 40 of the Federal Data Protection Act.
