§ 64 DSG NRW
Data transfer without appropriate safeguards
(1)Where, contrary to Section 62(1), number 2, no decision pursuant to Article 36(3) of Directive (EU) 2016/680 exists and there are also no appropriate safeguards within the meaning of Section 63(1), a transmission shall also be permissible, provided the other conditions of Section 62 are met, where the transmission is necessary
(2)1. to protect the vital interests of a natural person,
(3)2. to safeguard the legitimate interests of the data subject,
(4)3. to avert an imminent and substantial danger to public safety of a state,
(5)4. in individual cases for the purposes referred to in Section 35, or
(6)5. in individual cases for the establishment, exercise or defence of legal claims in connection with the purposes referred to in Section 35.
(7)The controller shall refrain from a transmission pursuant to paragraph 1 where the fundamental rights of the data subject outweigh the public interest in the transmission.
(8)For transmissions pursuant to paragraph 1, Section 63(2) shall apply accordingly.
