Clemency proceedings
(1)In clemency proceedings, the processing of personal data, including data within the meaning of Article 9(1) of Regulation (EU) 2016/679, shall be permissible insofar as it is necessary for the exercise of the right of pardon by the competent authorities. Data processing shall not be subject to supervision by the State Commissioner for Data Protection and Freedom of Information.
(2)In clemency proceedings, only Articles 5 to 7 and Chapter IV with the exception of Articles 33 and 34 of Regulation (EU) 2016/679 shall apply accordingly.
