§ 35 DSG NRW
Scope of application
(1)The provisions of this Part shall apply to the processing of personal data by
(2)1. police authorities,
(3)2. courts in criminal matters and the public prosecution authorities,
(4)3. criminal sentence enforcement and penal institutions,
(5)4. forensic committal authorities, and
(6)5. financial administration authorities
(7)in the performance of their tasks for the prevention, investigation, detection, prosecution and sanctioning of criminal offences or administrative offences and for the enforcement of criminal penalties. The prevention of criminal offences within the meaning of sentence 1 shall include the protection against and the prevention of dangers to public safety or public order.
(8)For regulatory authorities, the provisions of this Part shall apply insofar as they prosecute and sanction administrative offences and enforce sanctions.
(9)Insofar as special legal provisions are applicable to the processing of personal data, they shall take precedence over the provisions of this Act.
