§ 65 DSG NRW

Other data transfers to recipients in third countries

(1)Controllers may, provided the other conditions applicable to data transfers to third countries are met, in a particular individual case, directly transmit personal data to bodies in third countries not referred to in Section 63(1), number 1, where the transmission is absolutely necessary for the performance of their tasks and
(2)1. in the specific case, no fundamental rights and freedoms of the data subject outweigh the public interest in a transmission,
(3)2. the transmission to the bodies referred to in Section 62(1), number 1, would be ineffective or inappropriate, in particular because the transmission cannot be carried out in a timely manner, and
(4)3. the controller communicates the purposes of the processing to the recipient and indicates that the transmitted data may only be processed to the extent that their processing is necessary for these purposes.
(5)In the case of paragraph 1, the controller shall notify the bodies referred to in Section 62(1), number 1, of the transmission without delay, unless this would be ineffective or inappropriate.
(6)For transmissions pursuant to paragraph 1, Section 63(2) and (3) shall apply accordingly.
(7)In the case of transmissions pursuant to paragraph 1, the controller shall oblige the recipient to process the transmitted personal data without his or her consent only for the purpose for which they were transmitted.
(8)Provisions in bilateral or multilateral international agreements with third parties in the area of judicial cooperation in criminal matters and police cooperation shall remain unaffected.
