Advisory board
(1)An advisory board shall be established at the State Commissioner for Data Protection. It shall consist of nine members. The Landtag shall appoint six members, the Land government one member, the municipal umbrella organisations one member, and the ministry responsible for social affairs one member from the field of statutory social insurance providers. A deputy shall be appointed for each advisory board member at the same time.
(2)The members of the Landtag shall be appointed for the electoral term of the Landtag and the other members for four years. In their capacity as members of the advisory board, they shall not be bound by instructions or directives.
(3)The advisory board shall support the State Commissioner for Data Protection in his or her work. The independence of the State Commissioner for Data Protection and the reporting obligation to the Landtag shall not be affected thereby.
(4)The advisory board shall adopt its own rules of procedure. It shall convene at the request of any of its members or of the State Commissioner for Data Protection. The chair shall be held by a member of the advisory board from among the members of the Landtag.
(5)The State Commissioner for Data Protection may participate in all meetings. The chair of the advisory board shall invite him or her to the meetings in good time, providing the agenda. Before measures taken by the State Commissioner for Data Protection pursuant to Section 7, the advisory board may be given the opportunity to comment.
(6)The members of the advisory board shall, even after leaving office, maintain confidentiality regarding matters that have come to their knowledge in the course of their activities.
