Lodging complaints with the State Commissioner for Data Protection
(1)(Article 77 of Regulation (EU) 2016/679, Article 52 of Directive (EU) 2016/680)
(2)Any data subject may, without prejudice to any other administrative or judicial remedy, lodge a complaint directly with the State Commissioner for Data Protection where he or she considers that the processing of his or her personal data by public bodies of the Land infringes his or her rights. The State Commissioner for Data Protection shall inform the data subject of the progress and outcome of the complaint and shall point out the possibility of judicial redress pursuant to Section 9.
(3)No one shall be disadvantaged or subjected to reprisals for having exercised his or her right pursuant to paragraph 1.
(4)Where a data subject addresses the State Commissioner for Data Protection because he or she was not provided with information pursuant to Section 21(5) or special statutory provisions, the communication of the State Commissioner for Data Protection to the data subject shall not allow inferences as to the state of knowledge of the controller, unless the controller consents to more detailed information. The same shall apply where a data subject directly invokes the State Commissioner for Data Protection and the body competent for providing the information demonstrates to the State Commissioner, with reasons, that it would refuse information upon a request for information pursuant to the provisions referred to in sentence 1.
(5)The State Commissioner for Data Protection shall forward a complaint lodged with him or her concerning processing falling within the competence of a supervisory authority in another Member State of the European Union to the competent supervisory authority without delay.
