Judicial redress
(1)(Articles 58 and 78 of Regulation (EU) 2016/679, Article 53 of Directive (EU) 2016/680)
(2)For disputes between public bodies and the State Commissioner for Data Protection regarding rights under Article 78(1) and (2) of Regulation (EU) 2016/679 and Section 7(6), the administrative courts shall have jurisdiction. In proceedings pursuant to sentence 1, Section 20(2) to (4) and (6) and (7) of the Federal Data Protection Act (BDSG) of 30 June 2017 (BGBl. I p. 2097) shall apply accordingly.
(3)Paragraph 1 shall apply accordingly in favour of data subjects where the State Commissioner for Data Protection does not handle a complaint pursuant to Section 8 or does not inform the data subject within three months of the progress or outcome of the complaint. zur Einzelansicht § 9
