Data transfer without appropriate safeguards
(1)(Article 38 of Directive (EU) 2016/680)
(2)Where no adequacy decision within the meaning of Section 57(1) exists and there are also no appropriate safeguards within the meaning of Section 59(1), the transmission of personal data to a body in a third country or to an international organisation shall also be permissible where the transmission is necessary 1. to protect the vital interests of the data subject or another person, 2. to safeguard the legitimate interests of the data subject, 3. to avert an imminent and substantial danger to the public safety of a state, 4. in individual cases for the purposes referred to in Section 31, or 5. in individual cases for the establishment, exercise or defence of legal claims in connection with the purposes referred to in Section 31.
(3)The controller shall refrain from a transmission pursuant to paragraph 1 where the fundamental rights of the data subject outweigh the public interest in the transmission.
(4)Section 59(2) and (3) shall apply accordingly. zur Einzelansicht § 58
