§ 64 ThürDSG

Transitional provisions

(1)The term of office of the State Commissioner for Data Protection who holds the office of State Commissioner for Data Protection on 24 May 2018 shall not be interrupted by the entry into force of Regulation (EU) 2016/679 or this Act. If the State Commissioner for Data Protection already holds the office on 24 May 2018 by virtue of a re-election, a further re-election shall not be possible. Section 5(3), sentence 2, shall not apply to the incumbent pursuant to sentence 1.
(2)The State Commissioner for Data Protection who is appointed at the time of entry into force of this Act shall be deemed to be the supervisory authority within the meaning of this Act.
(3)Paragraph 1, sentence 1, shall apply accordingly to official data protection officers who are appointed on 24 May 2018.
(4)In the annual report for the year 2018 pursuant to Section 10(1) and Section 11(2), the Thuringian Data Protection Act in the version applicable on 24 May 2018 shall be taken as the basis for the reporting period from 1 January 2018 to 24 May 2018.
(5)Automated processing systems established within the scope of application of the Third Section at the time of entry into force of this Act shall be brought into compliance with Section 51 in a timely manner and, in exceptional cases where adaptation involves disproportionate effort, no later than 6 May 2023. zur Einzelansicht § 64
