Transmission

(2)The responsibility for the permissibility of the transmission of personal data shall lie with the transmitting body. Where the transmission is based on a request from a public recipient, the latter shall bear the responsibility. In this case, the transmitting body shall only verify whether the transmission request falls within the scope of the recipient's tasks, unless there is particular reason to examine the permissibility of the transmission.
(3)Where personal data which may be transmitted are combined with further personal data of the data subject or of a third party in files in such a way that separation is not possible or is only possible with disproportionate effort, the transmission of those further data shall also be permissible, insofar as the legitimate interests of the data subject or of a third party in maintaining their confidentiality do not prevail; the use of those data shall not be permissible.
(4)Where personal data are transmitted by means of an automated procedure, the responsibility for the permissibility of the individual retrieval shall lie with the retrieving body. zur Einzelansicht § 18
