Notification of data subjects
(1)(Article 13 of Directive (EU) 2016/680)
(2)The controller shall make available to the data subject at least the following further information: 1. the legal basis of the processing, 2. the storage period applicable to the data or, where that is not possible, the criteria for determining that period, 3. where applicable, the categories of recipients of the personal data, including in third countries or international organisations, 4. where necessary, further information, in particular where the personal data were collected without the knowledge of the data subject, 5. the right to lodge a complaint with the State Commissioner for Data Protection, and 6. the contact details of the State Commissioner for Data Protection.
(3)The controller may postpone, restrict or refrain from providing the information pursuant to paragraph 1 insofar as and for as long as, by reason of the particular circumstances of the individual case, 1. the performance of the tasks referred to in Section 31, 2. the prosecution of criminal offences or administrative offences, 3. public safety or public order, 4. the rights of third parties, or 5. the welfare of the Federation or a Land so require, provided that the interest of the controller in not providing the information outweighs the data subject's interest in being informed. In this case, the controller shall provide the information to the data subject as soon as it is no longer necessary to refrain from providing it.
(4)Paragraph 2 shall not apply where the data subject is deprived of liberty or the data were collected by means of covert measures. In these cases, the information pursuant to paragraph 1 shall be provided to the data subject upon termination of the measure or upon release, unless the provision of information would jeopardise the purpose of another measure.
(5)Where the controller refrains from or restricts the information pursuant to paragraph 2, he or she shall document the factual or legal reasons for the decision. zur Einzelansicht § 41
