§ 25 ThürDSG

Processing of personal data for the purposes of

(1)freedom of expression and information
(2)Where personal data are processed in the exercise of the right to freedom of expression and information for journalistic, artistic, literary or scientific purposes, only Article 5(1)(f) and Articles 24, 32 and 33 of Chapters II to VII and IX of Regulation (EU) 2016/679, as well as Section 83 BDSG, shall apply. Article 82 of Regulation (EU) 2016/679 and Section 83 BDSG shall apply with the proviso that liability shall only arise for damages resulting from a breach of data secrecy or from insufficient technical or organisational measures pursuant to Article 5(1)(f) and Article 24 of Regulation (EU) 2016/679.
(3)Where the processing of personal data pursuant to paragraph 1, sentence 1, leads to the dissemination of counter-statements of the data subject, or to declarations of undertaking, decisions or judgments regarding the cessation of dissemination or the retraction of the content of the data, these counter-statements, declarations of undertaking, decisions, judgments and retractions shall be added to the stored data, retained there for the same period as the data themselves, and transmitted jointly in the event of a transmission of the data.
(4)Paragraphs 1 and 2 shall also apply to activities carried out on a regular, i.e. not merely occasional, basis. A professional or ancillary professional exercise of the activities shall not be required. zur Einzelansicht § 25
