Procedure for the exercise of the rights of the data subject
(1)(Article 12(1) and (3) to (5) of Directive (EU) 2016/680)
(2)The controller shall communicate with data subjects using clear and plain language in a concise, intelligible and easily accessible form. Without prejudice to special requirements as to form, the controller should, in principle, respond to applications in the same form in which the application was submitted.
(3)Without prejudice to Section 42(5) and Section 43(4), the controller shall inform the data subject in writing of the action taken on his or her application.
(4)Information pursuant to Section 40, notifications pursuant to Section 41, communications pursuant to Section 56 and the processing of applications pursuant to Sections 42 and 43 shall be carried out free of charge for the data subject. In the case of manifestly unfounded or excessive applications by the data subject pursuant to Sections 42 and 43, the controller may either charge administrative costs based on the administrative effort involved or refuse to act on the application. In this case, the controller shall bear the burden of proof for the manifestly unfounded or excessive character of the application.
(5)Where the controller has reasonable doubts about the identity of the data subject who submits an application pursuant to Sections 42 or 43, the controller may request additional information or evidence from the data subject that is necessary to confirm his or her identity. zur Einzelansicht § 44
