Procedures for transmissions
(1)(Article 7(2), Article 9(3) and (4) of Directive (EU) 2016/680)
(2)The controller shall take appropriate measures to ensure that personal data which are inaccurate or no longer up to date are not transmitted or otherwise made available. To this end, the controller shall, insofar as reasonably possible, verify the quality of the data before their transmission or making available. With every transmission of personal data, the controller shall also, insofar as possible and appropriate, include information enabling the recipient to assess the accuracy, completeness and reliability of the personal data as well as their currency.
(3)Where special conditions apply to the processing of personal data, the transmitting body shall, in the case of data transmissions, inform the recipient of those conditions and the obligation to observe them. The duty to inform may be fulfilled by marking the data accordingly.
(4)The transmitting body shall not apply to recipients in other Member States of the European Union or to institutions and other bodies established pursuant to Chapters 4 and 5 of Title V of Part Three of the Treaty on the Functioning of the European Union any conditions that would not also apply to equivalent domestic data transmissions. zur Einzelansicht § 36
