Scope of application
(1)(Article 1(1), Article 2(1) of Directive (EU) 2016/680) The provisions of this Section shall apply to the processing of personal data by public bodies competent for the prevention, investigation, detection, prosecution or sanctioning of criminal offences or administrative offences insofar as they process data for the purpose of performing these tasks. The public bodies shall be deemed to be controllers. The prevention of criminal offences within the meaning of sentence 1 shall include the protection against and the prevention of dangers to public safety. Sentences 1 and 2 shall furthermore apply to those public bodies that are competent for the enforcement of penalties or measures within the meaning of Section 11(1), number 8, of the Criminal Code, of educational measures or disciplinary measures within the meaning of the Youth Courts Act, or of fines. Insofar as this Section contains provisions for processors, it shall also apply to them. zur Einzelansicht § 31
