Restriction of the duty to notify
(1)(Supplementary to Article 34 of Regulation [EU] 2016/679) The public body may refrain from notifying the person affected by a breach of the protection of personal data insofar as and for as long as 1. the notification would endanger public security or otherwise be detrimental to the welfare of the Federation or a Land, 2. the data or the fact of processing must be kept secret pursuant to a legal provision or for the protection of the data subject or the rights of other persons, or 3. the notification would endanger the security of information technology systems and therefore the interest of the data subject in being notified must take second place. zur Einzelansicht § 11 ABSCHNITT 4 Besondere Verarbeitungssituationen
