Data processing in joint offices
(1)The locally competent public body may only make personal data available for processing for its own tasks to its own employees working in a joint office pursuant to Section 16(1) of the State Administration Act. Technical and organisational measures shall be taken to ensure that access to the data referred to in sentence 1 by employees of other authorities is not possible. Insofar as this is necessary to ensure the proper performance of its own tasks, the locally competent public body may also make personal data available for processing to employees of other authorities working in the joint office. In the context of such data processing, the employees of other authorities shall be subject to the instructions of the locally competent public body. With regard to data of which they become aware in the course of their work for the other authority, they shall observe data secrecy vis-a-vis their own authority. The details shall be regulated by joint internal service instructions. The locally competent public body shall remain the controller.
