Criminal provision
(1)(Supplementary to Article 84 of Regulation [EU] 2016/679)
(2)Any person who 1. without authorisation stores, uses, alters, transmits or erases personal data protected by this Act or by Regulation (EU) 2016/679 that are not publicly accessible,
a)stores, uses, alters, transmits or erases such data,
b)makes such data available for retrieval by means of automated procedures, or
c)retrieves such data or obtains them from files for himself or herself or another person, or 2. obtains personal data protected by this Act or by Regulation (EU) 2016/679 that are not publicly accessible by providing false information, and in doing so acts for remuneration or with the intent to enrich himself or herself or another person or to cause damage to another person, shall be punished with imprisonment of up to two years or a fine.
(3)The offence shall only be prosecuted upon complaint. Those entitled to file a complaint shall be the data subject, the public body, the processor, the State Commissioner for Data Protection, the Broadcasting Commissioner for Data Protection and the supervisory authorities. zur Einzelansicht § 29 ABSCHNITT 8 Übergangsbestimmungen
