§ 5 LDSG BW

Processing for other purposes

(1)(Supplementary to Article 6(3) and (4) of Regulation [EU] 2016/679)
(2)The processing of personal data for a purpose other than that for which they were collected shall, without prejudice to the provisions of Regulation [EU] 2016/679, be lawful where 1. it is necessary to avert substantial detriment to the public interest or a directly imminent threat to public security or to safeguard substantial interests of the public welfare, 2. it is necessary for the protection of the data subject or to avert a serious impairment of the rights and freedoms of another person, 3. in the course of lawful performance of duties, indications of criminal offences or administrative offences of significant importance arise and the notification of the authorities competent for prevention, prosecution or enforcement is necessary, or 4. statements of the data subject need to be verified because there are factual indications that they are inaccurate, insofar as the processing is necessary and proportionate.
(3)Processing shall be deemed compatible with the original purposes where it 1. is required for the exercise of supervisory and control powers, or 2. serves the auditing of accounts, the conduct of organisational reviews or the testing and maintenance of automated procedures. This shall also apply to processing for the body's own training and continuing education purposes, provided that the legitimate interests of the data subject do not preclude this.
(4)By derogation from Article 13 of Regulation [EU] 2016/679, the data subject shall not be informed about the data processing pursuant to paragraph 1, numbers 1 to 4, insofar as and for as long as such information would jeopardise the purpose of the processing and the interests of the public body in not providing the information outweigh the interests of the data subject.
(5)Personal data processed exclusively for the purposes of data protection supervision, data security or ensuring the proper operation of a data processing system may only be processed for these purposes and for related measures against employees or insofar as this is necessary for the prevention or prosecution of criminal offences against life, bodily integrity or personal freedom. zur Einzelansicht § 5
