Data processing for scientific
(1)or historical research purposes and for statistical purposes
(2)Public bodies may process personal data, including special categories of personal data, for scientific or historical research purposes or for statistical purposes where the purposes cannot be achieved by other means or only with disproportionate effort and the interests of the public body in the conduct of the research or statistical project outweigh the interests of the data subject in excluding the processing. Special categories of personal data shall be those referred to in Article 9(1) of Regulation (EU) 2016/679.
(3)The personal data shall be anonymised as soon as the research or statistical purpose permits, unless the legitimate interests of the data subject preclude this. Until anonymisation, the features by means of which individual details can be attributed to an identified or identifiable person shall be stored separately. They may only be combined with the individual details insofar as the research or statistical purpose so requires.
(4)Public bodies conducting scientific or historical research may only publish personal data, other than with the consent of the data subject, insofar as this is indispensable for the presentation of research findings on events of contemporary history.
(5)The rights of the data subject provided for in Articles 15, 16, 18 and 21 of Regulation (EU) 2016/679 shall be restricted insofar as these rights are likely to render the respective research or statistical purposes impossible or seriously impair them and the restriction is necessary for the fulfilment of the respective research or statistical purposes. The right of access pursuant to Article 15 of Regulation (EU) 2016/679 shall furthermore not apply where the data are necessary for the purposes of scientific research and the provision of information would require disproportionate effort. zur Einzelansicht § 13
