§ 17 LDSG BW

Processing of personal data

(1)in the public interest
(2)For the verification of the reliability of visitors, employees of enterprises and other organisations, and other persons who are to gain access to security-relevant or safety-relevant areas for which public bodies bear responsibility, Section 15(1) sentence 1 shall apply accordingly, with the proviso that the consent of the data subject shall additionally be required. Special categories of personal data and data on criminal convictions and offences or related security measures may only be processed on the basis of express consent.
(3)By derogation from Article 9(1) of Regulation (EU) 2016/679, the processing of special categories of personal data shall be lawful where the processing is necessary for reasons of substantial public interest or to avert a substantial threat to public security, and the interests of the public body in the data processing outweigh the interests of the data subject. zur Einzelansicht § 17
