Data protection supervision
(1)The state parliament may adopt a data protection supervisory regulation for the supervision of the processing of personal data in the state parliament, establishing its own supervisory body pursuant to Article 51 of Regulation (EU) 2016/679, which shall contain in particular provisions on 1. the establishment, composition and number of members, 2. the commencement and end of the term of office of the members, 3. decision-making procedures.
(2)With regard to the tasks of the body, Article 57 of Regulation (EU) 2016/679 shall apply.
(3)With regard to the independence of the supervisory body, Article 52(1) to (3) of Regulation (EU) 2016/679 shall apply.
(4)To ensure the required expertise pursuant to Article 53(2) of Regulation (EU) 2016/679, at least one member of the supervisory body must possess the qualification for judicial office.
(5)With regard to investigative and corrective powers as well as authorisation and advisory powers, Article 58 of Regulation (EU) 2016/679 shall apply, subject to the restriction in Section 28. zur Einzelansicht § 19e ABSCHNITT 6 Unabhängige Aufsichtsbehörden
