§ 19d LDSG BW

Rights of data subjects

(1)For data processing operations in the context of the performance of tasks pursuant to Section 19a(1), the rights of data subjects pursuant to Articles 13 to 19 and 21 of Regulation (EU) 2016/679 shall apply, with regard to Article 23(1)(e) and (h) of Regulation (EU) 2016/679, subject to the provisions of paragraphs 2 to 8.
(2)The information prescribed by Articles 13 and 14 of Regulation (EU) 2016/679 shall be made available in the form of a declaration by electronic means (privacy policy). The information obligations pursuant to Article 13(1)(e) and Article 14(1)(d) and (e) and (2)(f) of Regulation (EU) 2016/679 shall not apply.
(3)The right of access pursuant to Article 15 of Regulation (EU) 2016/679 shall not apply 1. with regard to non-public information, classified documents or subjects and content of non-public, confidential or secret deliberations, negotiations, sessions and decisions, 2. with regard to the rights pursuant to Article 15(1)(c) and (g) and (3) of Regulation (EU) 2016/679.
(4)The right to erasure pursuant to Article 17 of Regulation (EU) 2016/679 shall only comprise the right to have published personal data removed from the parliament's website.
(5)The right to rectification pursuant to Article 16 of Regulation (EU) 2016/679 shall be limited to typographical errors and other manifest inaccuracies. With regard to inaccurate or incomplete personal data beyond this, the data subject may submit a supplementary statement, which shall be published together with the personal data complained of as inaccurate or incomplete, at no cost to the data subject.
(6)The right to restriction of processing pursuant to Article 18 of Regulation (EU) 2016/679 and the notification obligation pursuant to Article 19 of Regulation (EU) 2016/679 shall not apply.
(7)The right to object pursuant to Article 21 of Regulation (EU) 2016/679 shall be limited to publication. In place of proof of overriding compelling legitimate grounds for the processing by the controller pursuant to Article 21(1) sentence 2 of Regulation (EU) 2016/679, the plausible demonstration of such grounds shall suffice.
(8)All of the restrictions referred to in paragraphs 4 to 7 shall only apply insofar as the respective restriction is suitable and necessary for the fulfilment of the tasks pursuant to Section 19a(1). zur Einzelansicht § 19d
