§ 9 LDSG BW

Restriction of the right of access

(1)(Supplementary to Article 15 of Regulation [EU] 2016/679)
(2)The provision of information may be refused for the reasons set out in Section 8(1)(1) to (4). The data subject may furthermore not request information insofar as and for as long as the personal data are stored exclusively for purposes of data security or data protection supervision and processing for other purposes is excluded by appropriate technical and organisational measures, and therefore the interest of the data subject in obtaining the information must take second place.
(3)Where the public body processes a large amount of information about the data subject, it may limit itself to specifying the processing operations and the types of data processed, provided that it requests the data subject to specify which information or which processing operations his or her request for information relates to. Where the data subject does not comply with the request, the information may be refused insofar as the provision of information would cause an unreasonable burden.
(4)Section 8(2) shall apply accordingly.
(5)The refusal to provide information shall be substantiated, unless the communication of the reasons would jeopardise the purpose pursued by the refusal of information. In such case, the reasons for the refusal shall be documented. The data subject shall be informed of the possibility of lodging a complaint with the State Commissioner for Data Protection.
(6)Where no information is provided to the data subject, such information shall, at the request of the data subject, be provided to the State Commissioner for Data Protection, unless the competent supreme Land authority determines in the individual case that this would endanger the security of the Federation or a Land. The notification from the State Commissioner for Data Protection to the data subject regarding the result of the data protection review shall not allow any conclusions to be drawn as to the knowledge of the public body, unless the latter consents to more extensive disclosure. zur Einzelansicht § 9
