§ 15 LDSG RP
Competence and Organisation
(1)The State Commissioner for Data Protection and Freedom of Information shall be the supervisory authority within the meaning of Article 51 of the General Data Protection Regulation insofar as the scope of application of this Act is opened.
(2)The State Commissioner for Data Protection and Freedom of Information shall also be the supervisory authority within the meaning of Section 40 BDSG for the monitoring of data protection in the data processing of non-public bodies and public-law competitive undertakings.
(3)The State Commissioner for Data Protection and Freedom of Information may not hold any other salaried office or practise any profession and may not belong to the management or the supervisory board or administrative board of any profit-oriented undertaking, nor to any government or legislative body of the Federation or of a Land. In addition to the regulation in Article 52(3) of the General Data Protection Regulation, the State Commissioner for Data Protection and Freedom of Information shall also refrain from any actions and any paid or unpaid activities incompatible with the tasks of his or her former office for a period of five years after his or her term of office.
(4)The State Commissioner for Data Protection and Freedom of Information shall be established under the President of the Landtag and shall have the status of a supreme Land authority with its seat in Mainz. The necessary staff and material resources shall be made available for the fulfilment of his or her tasks. The funds shall be shown in a separate chapter of the Landtag's budget.
(5)The staff shall be subject to the official supervision of the State Commissioner for Data Protection and Freedom of Information. The State Commissioner for Data Protection and Freedom of Information shall exercise the right of appointment, transfer, secondment, retirement and dismissal of civil servants of the first, second and third entry grades, irrespective of their salary classification, as well as of the fourth entry grade up to and including pay grade A 15. For civil servants of the fourth entry grade from pay grade A 16, the President of the Landtag shall exercise this right upon nomination and in agreement with the State Commissioner for Data Protection and Freedom of Information. Civil servants may only be transferred or seconded to the State Commissioner for Data Protection and Freedom of Information in agreement with the latter.
