Data Processing for Scientific
(1)or Historical Research Purposes and for Statistical Purposes
(2)The controller carrying out scientific and historical research may process personal data within the meaning of Article 9(1) of the General Data Protection Regulation without the consent of the data subject for scientific and historical research purposes, if the public interest in the conduct of the research project substantially outweighs the interest of the data subject in the exclusion of the collection and the purpose of the research cannot be achieved by other means or only with disproportionate effort.
(3)Personal data collected or stored for the purposes of scientific or historical research may be processed in accordance with paragraph 1 for further purposes compatible with the original purpose of the research.
(4)Effective consent of the data subject to the processing of genetic or biometric data or health data shall require written form.
(5)The personal data shall be anonymized as soon as the research purpose permits. It must be ensured that the characteristics by which individual details about personal or factual circumstances can be attributed to a specific or identifiable person are managed by a body that is spatially, organizationally and personally separate from the researching body, unless there are compelling scientific reasons to the contrary. The characteristics may only be combined with the individual details insofar as the research purpose requires this.
(6)The controller carrying out scientific and historical research may only publish personal data if 1. the data subject has consented, or 2. this is indispensable for the presentation of research results on events of contemporary history and overriding legitimate interests of the data subject do not preclude this.
