Data Transfers without Appropriate Safeguards
(1)Where, contrary to Section 66(1) No. 3, no decision pursuant to Article 36(3) of Directive (EU) 2016/680 exists and there are also no appropriate safeguards within the meaning of Section 67(1), a transfer shall, where the other conditions of Section 66 are met, also be permissible where the transfer is necessary 1. to protect the vital interests of a natural person, 2. to safeguard the legitimate interests of the data subject, where this is provided for under the applicable law of the Member State from which the personal data are transferred, 3. to avert an imminent and substantial threat to the public security of a state, 4. in an individual case for the purposes referred to in Section 26(1), or 5. in an individual case for the establishment, exercise or defence of legal claims in connection with the purposes referred to in Section 26(1).
(2)The controller shall refrain from a transfer pursuant to paragraph 1 where the fundamental rights of the data subject outweigh the public interest in the transfer within the meaning of paragraph 1 Nos. 4 and 5.
