Data Protection Commission
(1)A Data Protection Commission shall be established under the State Commissioner for Data Protection and Freedom of Information, consisting of eight members. Seven members shall be delegated to the Data Protection Commission by the Landtag and one member by the Land Government. The members to be delegated by the Landtag shall be distributed among the parliamentary groups according to the d'Hondt method, with each parliamentary group providing at least one member.
(2)The members of the Data Protection Commission shall be delegated by the Landtag from among its members for the duration of the Landtag's legislative period, and by the Land Government for a period of five years.
(3)The Data Protection Commission shall support the State Commissioner for Data Protection and Freedom of Information in the performance of his or her tasks under this Act. The State Commissioner for Data Protection and Freedom of Information shall participate in the meetings of the Data Protection Commission. The State Commissioner for Data Protection and Freedom of Information shall inform the Data Protection Commission about measures pursuant to Section 17. The activity report of the State Commissioner for Data Protection and Freedom of Information shall be discussed in the Data Protection Commission a reasonable time before transmission to the Landtag and the Land Government.
(4)The Data Protection Commission shall convene at the request of one of its members or of the State Commissioner for Data Protection and Freedom of Information.
(5)The Data Protection Commission shall elect a chairperson and a deputy chairperson from among the members delegated by the Landtag. It shall adopt its own rules of procedure.
(6)The members of the Data Protection Commission shall be obliged to maintain secrecy, even after their departure from office, regarding matters that have come to their knowledge in the course of their official activity. This shall not apply to communications in official dealings or to facts that are publicly known or that by their nature do not require secrecy.
(7)The chairperson of the Data Protection Commission shall receive a monthly expense allowance in the same amount as the chairperson of a committee of the Landtag.
(8)The members of the Data Protection Commission shall receive travel expense reimbursement in accordance with the provisions of the Land Travel Expenses Act. zur Einzelansicht § 18 Abschnitt 4 Besonderer Datenschutz
