Transmission to Public Bodies
(1)The responsibility for the lawfulness of the transmission of personal data shall lie with the transmitting body. Where the transmission is made upon request of a public body, that body shall bear the responsibility. The transmitting body shall then only verify whether the transmission request falls within the scope of the requesting body's tasks. It shall review the lawfulness of the request only where there is reason to do so in the individual case; the requesting body shall provide the transmitting body with the information necessary for this review. Where the transmission takes place by automated retrieval, the responsibility for the lawfulness of the retrieval shall lie with the receiving body.
(2)Where personal data are linked with further personal data of the data subject or of third parties in such a way that separation is not possible or only possible with unreasonable effort, the transmission of those data to public bodies shall also be permissible, provided that legitimate interests of the data subject or of third parties in the secrecy thereof do not preclude this; further processing of such data shall be unlawful. zur Einzelansicht § 5
