Appeal to the State Commissioner
(1)for Data Protection and Freedom of Information
(2)Every data subject may, without prejudice to any other remedy, lodge a complaint with the State Commissioner for Data Protection and Freedom of Information if the data subject considers that the processing of personal data relating to him or her by public bodies for the purposes referred to in Section 26(1) infringes his or her rights. This shall not apply to the processing of personal data by courts insofar as they process the data in the exercise of their judicial activities. The State Commissioner for Data Protection and Freedom of Information shall inform the data subject of the progress and the outcome of the complaint, including the possibility of a judicial remedy under Section 49.
(3)Where a complaint lodged with the State Commissioner for Data Protection and Freedom of Information concerns processing that falls within the competence of a supervisory authority of another Member State of the European Union, the State Commissioner shall forward the complaint without delay to the competent supervisory authority of the other state. In such cases, he or she shall inform the data subject about the forwarding and shall provide further assistance at the request of the data subject. zur Einzelansicht § 48
