Notification of Data Subjects
(1)Where the notification of data subjects about the processing of personal data relating to them is provided for or ordered in specific legal provisions, in particular in the case of covert measures, such notification shall contain at least the following information: 1. the information referred to in Section 43, 2. the legal basis of the processing, 3. the period for which the personal data will be stored or, where this is not possible, the criteria used to determine that period, 4. where applicable, the categories of recipients of the personal data, and 5. where necessary, further information, in particular where the personal data were collected without the knowledge of the data subject.
(2)In the cases of paragraph 1, the controller may delay, restrict or refrain from providing the notification insofar and for as long as otherwise 1. the fulfilment of the tasks referred to in Section 26(1), 2. public security, or 3. the rights of third parties would be jeopardized, provided that the interest in avoiding such jeopardy outweighs the information interest of the data subject.
(3)Where the notification relates to the transmission of personal data to intelligence agencies of the Federation and the Laender, the Federal Intelligence Service or the Military Counter-Intelligence Service, it shall only be permissible with the consent of those bodies.
(4)In case of the restriction under paragraph 2, Section 45(7) shall apply accordingly. zur Einzelansicht § 44
