Scope of Application
(1)The provisions of this Part shall apply to courts and public prosecution offices as well as to police authorities and regulatory authorities, insofar as they process personal data for the purposes of the prevention, investigation, detection, prosecution or punishment of criminal offences or administrative offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security. The bodies designated in sentence 1 shall be deemed to be controllers. Insofar as this Part contains provisions for processors, it shall also apply to them.
(2)Processing of personal data within the meaning of paragraph 1 shall mean the wholly or partly automated processing of personal data as well as the non-automated processing of personal data which are stored or are intended to be stored in a filing system. zur Einzelansicht § 26
