Designation
(1)Public bodies shall designate a data protection officer.
(2)A joint data protection officer may be designated for several public bodies, taking into account their organisational structure and size.
(3)The data protection officer shall be designated on the basis of his or her professional qualities and, in particular, expert knowledge of data protection law and practice, as well as his or her ability to fulfil the tasks referred to in Section 39.
(4)The data protection officer may be in an employment relationship with the public body or fulfil his or her tasks on the basis of a service contract.
(5)The public body shall publish the contact details of the data protection officer and communicate such details to the State Commissioner for Data Protection and Freedom of Information. zur Einzelansicht § 37
