§ 11 BlnDSG
Tasks
(1)Without prejudice to other tasks referred to in Regulation (EU) 2016/679, the Berlin Commissioner for Data Protection and Freedom of Information shall have the tasks of 1. monitoring and enforcing the application of this Act and other data protection provisions, including the legal provisions adopted for the transposition of Directive (EU) 2016/680, 2. raising awareness among the public of the risks, rules, safeguards and rights in connection with the processing of personal data and informing them thereof, with specific measures for children receiving particular attention, 3. advising the House of Representatives, the Senate and other institutions and bodies on legislative and administrative measures for the protection of the rights and freedoms of natural persons with regard to the processing of personal data, 4. raising awareness among controllers and processors of their obligations arising from this Act and other data protection provisions, including the legal provisions adopted for the transposition of Directive (EU) 2016/680, 5. providing information, on request, to any data subject concerning the exercise of their rights under this Act and other data protection provisions, including the legal provisions adopted for the transposition of Directive (EU) 2016/680, and, where appropriate, cooperating with the supervisory authorities of the Federation, the Laender or other Member States of the European Union for this purpose, 6. dealing with complaints lodged by a data subject or by a body, organisation or association pursuant to Article 55 of Directive (EU) 2016/680, investigating the subject matter of the complaint to the extent appropriate and informing the complainant of the progress and outcome of the investigation within a reasonable period, in particular where further investigation or coordination with another supervisory authority is necessary, 7. cooperating with other supervisory authorities, including by sharing information, and providing them with mutual assistance, in order to ensure the consistent application and enforcement of this Act and other data protection provisions, including the legal provisions adopted for the transposition of Directive (EU) 2016/680, 8. conducting investigations on the application of this Act and other data protection provisions, including the legal provisions adopted for the transposition of Directive (EU) 2016/680, including on the basis of information received from another supervisory authority or another public authority, 9. monitoring relevant developments insofar as they have an impact on the protection of personal data, in particular the development of information and communication technology and business practices, 10. providing advice with regard to the processing operations referred to in Section 55, and 11. contributing to the activities of the European Data Protection Board. Within the scope of application of Directive (EU) 2016/680, the Berlin Commissioner for Data Protection and Freedom of Information shall also perform the task pursuant to Section 46.
(2)For the fulfilment of the task referred to in paragraph 1 sentence 1 no. 3, the Berlin Commissioner for Data Protection and Freedom of Information may, on all matters relating to the protection of personal data, issue opinions on their own initiative or upon request to the House of Representatives or one of its committees, the Senate, other institutions and bodies, and the public. The Berlin Commissioner for Data Protection and Freedom of Information shall be consulted before the adoption of laws, statutory instruments or administrative regulations insofar as they concern the processing of personal data.
(3)The Berlin Commissioner for Data Protection and Freedom of Information shall facilitate the lodging of the complaints referred to in paragraph 1 sentence 1 no. 6 by measures such as the provision of a complaint form which can also be completed electronically, without excluding other means of communication.
(4)The fulfilment of the tasks of the Berlin Commissioner for Data Protection and Freedom of Information shall be free of charge for the data subject. In the case of manifestly unfounded or excessive requests, in particular in the case of frequent repetition, the Berlin Commissioner for Data Protection and Freedom of Information may charge a reasonable fee based on administrative costs or refuse to act on the request. In such case, the Berlin Commissioner for Data Protection and Freedom of Information shall bear the burden of proving the manifestly unfounded or excessive nature of the request. zur Einzelansicht § 11
