§ 68 BlnDSG

Mutual Assistance

(1)The Berlin Commissioner for Data Protection and Freedom of Information shall transmit information and provide mutual assistance to the data protection supervisory authorities of the Federation and the Laender, as well as in other Member States of the European Union, insofar as this is necessary for the uniform transposition and application of Directive (EU) 2016/680. Mutual assistance shall relate in particular to requests for information and supervisory measures, for example requests for consultation or for the carrying out of inspections and investigations.
(2)The Berlin Commissioner for Data Protection and Freedom of Information shall take all appropriate measures to comply with requests for mutual assistance without undue delay and no later than one month after their receipt.
(3)The Berlin Commissioner for Data Protection and Freedom of Information may refuse requests for mutual assistance only where 1. the Commissioner is not competent for the subject matter of the request or for the measures to be taken, or 2. compliance with the request would be in breach of legal provisions.
(4)The Berlin Commissioner for Data Protection and Freedom of Information shall inform the requesting supervisory authority of the other state of the results or, where applicable, of the progress of the measures taken to comply with the request for mutual assistance. The Commissioner shall explain the reasons for the refusal of a request in the case of paragraph 3.
(5)The Berlin Commissioner for Data Protection and Freedom of Information shall, as a rule, transmit the information requested by the supervisory authority of the other state electronically and in a standardised format.
(6)The Berlin Commissioner for Data Protection and Freedom of Information shall process requests for mutual assistance free of charge, unless the Commissioner has agreed with the supervisory authority of the Federation, the respective Land or the other Member State of the European Union on the reimbursement of expenditure incurred in the individual case.
(7)A request for mutual assistance by the Berlin Commissioner for Data Protection and Freedom of Information shall contain all necessary information; this shall include in particular the purpose and the justification of the request.
