Right to Erasure
(1)Insofar as public bodies are obliged to offer records to a public archive for accession, personal data shall be erased where the accession of the offered records has been rejected by the public archive as not archivally valuable or where no decision on archival value has been taken after the expiry of the period specified in Section 7(1) sentence 2 of the Archives Act of the Land of Berlin of 14 March 2016 (GVBl. p. 96) following the offer. Insofar as an obligation pursuant to sentence 1 exists, the obligation of the controller to offer the records to the public archive without undue delay shall take the place of the right to erasure pursuant to Article 17(1)(a) of Regulation (EU) 2016/679. zur Einzelansicht § 25 Kapitel 4 Pflichten der Verantwortlichen und Auftragsverarbeiter
