§ 35 BlnDSG

Processing for Scientific, Historical,

(1)Archival and Statistical Purposes
(2)The processing of personal data, including special categories of personal data, shall also be permissible without consent for the fulfilment of one of the tasks referred to in Section 30(1) and (2) for scientific or historical research purposes in the public interest, or for archival or statistical purposes, where the public interest in the conduct of the project significantly outweighs the legitimate interests of the data subject and the respective purpose cannot be achieved by other means. Data transmitted pursuant to sentence 1 may not be processed for other purposes.
(3)The controller shall provide suitable safeguards for the rights and freedoms of the data subjects. The data shall in particular be anonymised as soon as the respective purpose permits, unless the legitimate interests of the data subject preclude this. Until anonymisation takes place, the identifiers by which individual data on personal or factual circumstances can be attributed to a specific or identifiable person shall be stored separately. They may only be combined with the individual data insofar as the respective purpose requires this. They shall be deleted as soon as the respective purpose has been achieved.
(4)The rights of the data subject provided for in Sections 41 to 44 shall be restricted insofar as such rights are likely to render impossible or seriously impair the achievement of the research or statistical purposes and the restriction is necessary for the fulfilment of the research or statistical purposes. The right of access pursuant to Section 43 shall furthermore not apply where the data are necessary for purposes of scientific research and the provision of information would require a disproportionate effort.
