Other Data Transmissions to Recipients in Third Countries
(1)Where the other conditions for data transmissions to third countries are met, the controller may, in a specific individual case, transmit personal data directly to bodies in third countries other than those referred to in Section 64(1) no. 1, where the transmission is necessary for the fulfilment of its tasks and 1. in the specific case, no fundamental rights of the data subject outweigh the public interest in the transmission, 2. the controller considers the transmission to the bodies referred to in Section 64(1) no. 1 to be ineffective or inappropriate, in particular because it cannot be carried out in a timely manner, and 3. the controller informs the recipient of the purposes of the processing and draws the recipient's attention to the fact that the transmitted data may only be processed to the extent necessary for those purposes.
(2)In the case of paragraph 1, the controller shall inform the bodies referred to in Section 64(1) no. 1 of the transmission without undue delay, unless this would be ineffective or inappropriate.
(3)Section 65(2) and (3) shall apply accordingly to transmissions pursuant to paragraph 1.
(4)In the case of transmissions pursuant to paragraph 1, the controller shall require the recipient to process the transmitted personal data only for the purpose for which they were transmitted.
