§ 6 BlnDSG

Tasks

(1)The data protection officer shall have at least the following tasks: 1. informing and advising the public body and its employees who carry out processing about their obligations under this Act and other data protection provisions, including the legal provisions adopted for the transposition of Directive (EU) 2016/680; 2. monitoring compliance with this Act and other data protection provisions, including the legal provisions adopted for the transposition of Directive (EU) 2016/680, as well as the strategies of the public body for the protection of personal data, including the assignment of responsibilities, the awareness-raising and training of staff involved in processing operations and the related audits; 3. advising in connection with the data protection impact assessment and monitoring its implementation pursuant to Section 53; 4. cooperation with the supervisory authority; 5. acting as a contact point for the supervisory authority on issues relating to processing, including the prior consultation pursuant to Section 55, and, where appropriate, consultation on all other matters.
(2)The tasks of the data protection officer referred to in paragraph 1 shall not relate to the processing of personal data by courts in the context of their judicial activities or by the Court of Auditors in the context of its independent activities.
(3)The data protection officer may perform other tasks and duties. The public body shall ensure that such tasks and duties do not lead to a conflict of interest.
(4)The data protection officer shall, in the fulfilment of their tasks, give due regard to the risk associated with the processing operations, taking into account the nature, scope, context and purposes of the processing. zur Einzelansicht § 6 Kapitel 4 Berliner Beauftragte oder Beauftragter für Datenschutz und Informationsfreiheit
