Rectification and Erasure of Personal
(1)Data and Restriction of Processing
(2)The controller shall rectify personal data that are inaccurate and shall complete incomplete data where this is appropriate taking into account the purposes of the processing.
(3)The controller shall erase personal data without undue delay where their processing is unlawful, they must be erased to comply with a legal obligation, or their knowledge is no longer necessary for the performance of the controller's task.
(4)Section 44(3) to (5) shall apply accordingly. Where inaccurate personal data or personal data that have been unlawfully transmitted are concerned, the recipient shall also be notified thereof.
(5)Without prejudice to maximum storage or erasure periods laid down in legal provisions, the controller shall provide for appropriate periods for the erasure of personal data or for a regular review of the necessity of their storage, and shall ensure compliance with those periods through procedural safeguards. zur Einzelansicht § 61
