Processing of Personal Data for Scientific
(1)or Historical Research Purposes and for Statistical Purposes
(2)The processing of personal data, including special categories of personal data within the meaning of Article 9(1) of Regulation (EU) 2016/679, shall also be permissible without consent for the fulfilment of a task for scientific or historical research purposes in the public interest or for statistical purposes, where the public interest in the conduct of the project significantly outweighs the legitimate interests of the data subject and the purpose cannot be achieved by other means. Data transmitted pursuant to sentence 1 may not be processed for other purposes.
(3)The data shall be anonymised as soon as the research or statistical purpose permits, unless the legitimate interests of the data subject preclude this. Until anonymisation takes place, the identifiers by which individual data on personal or factual circumstances can be attributed to a specific or identifiable person shall be stored separately; they may only be combined with the individual data insofar as the research or statistical purpose requires this. The data shall be deleted as soon as the purpose has been achieved. For the processing of special categories of personal data within the meaning of Article 9(1) of Regulation (EU) 2016/679, Section 14(3) shall remain unaffected.
(4)Public bodies that conduct scientific and historical research may publish personal data only where 1. the data subject has given consent, or 2. publication is necessary for the presentation of research findings on events of contemporary history, unless the legitimate interests of the data subject prevail.
(5)The rights of the data subject provided for in Articles 15, 16, 18 and 21 of Regulation (EU) 2016/679 shall be restricted insofar as such rights are likely to render impossible or seriously impair the achievement of the research or statistical purposes and the restriction is necessary for the fulfilment of the research or statistical purposes. The right of access pursuant to Article 15 of Regulation (EU) 2016/679 shall furthermore not apply where the data are necessary for purposes of scientific research and the provision of information would require a disproportionate effort. zur Einzelansicht § 17
