Designation
(1)Public bodies shall designate a data protection officer. This shall also apply to public bodies that participate in competition.
(2)A joint data protection officer may be designated for several public bodies, taking into account their organisational structure and their size.
(3)A deputy shall be designated for the person designated pursuant to paragraph 1 sentence 1 or paragraph 2. The provisions of this Chapter shall apply accordingly to the deputy.
(4)The data protection officer shall be designated on the basis of professional qualifications and, in particular, expert knowledge of data protection law and practice, as well as the ability to fulfil the tasks referred to in Section 6.
(5)The data protection officer may be an employee of the public body or may fulfil their tasks on the basis of a service contract.
(6)The public body shall publish the contact details of the data protection officer and shall communicate such data to the Berlin Commissioner for Data Protection and Freedom of Information. zur Einzelansicht § 4
