§ 66 BlnDSG
Data Transmission Without Appropriate Safeguards
(1)Where, contrary to Section 64(1) no. 2, no decision pursuant to Article 36(3) of Directive (EU) 2016/680 exists and no appropriate safeguards within the meaning of Section 65(1) exist either, a transmission shall also be permissible, where the other conditions of Section 64 are met, where the transmission is necessary 1. to protect the vital interests of a natural person, 2. to safeguard the legitimate interests of the data subject, 3. to avert a present and substantial threat to the public safety of a state, 4. in an individual case for the purposes referred to in Section 30, or 5. in an individual case for the establishment, exercise or defence of legal claims in connection with the purposes referred to in Section 30.
(2)The controller shall refrain from a transmission pursuant to paragraph 1 where the fundamental rights of the data subject outweigh the public interest in the transmission.
(3)Section 65(2) and (3) shall apply accordingly to transmissions pursuant to paragraph 1. zur Einzelansicht § 66
