Processing of Special Categories of Personal Data
(1)The processing of special categories of personal data shall only be permissible where it is necessary 1. for the performance of the task, 2. for the protection of the vital interests of a natural person, or 3. where it relates to data manifestly made public by the data subject.
(2)Where special categories of personal data are processed, suitable safeguards for the rights of the data subjects shall be provided. Suitable safeguards may in particular include 1. binding procedural rules establishing specific requirements for data security or data protection control, 2. the determination of specific review periods for erasure, 3. the sensitisation of those involved in processing operations, 4. the restriction of access to personal data within the controller, 5. the separate processing from other data, 6. the pseudonymisation of personal data, 7. the encryption of personal data, or 8. specific procedural rules which, in the event of transmission or processing for other purposes, ensure the lawfulness of the processing. zur Einzelansicht § 33
