Competence
(1)The Berlin Commissioner for Data Protection and Freedom of Information shall be the supervisory authority for the public bodies of the Land of Berlin.
(2)The Berlin Commissioner for Data Protection and Freedom of Information shall be the supervisory authority pursuant to Section 40 of the Federal Data Protection Act for data processing by non-public bodies and public bodies insofar as the latter participate in competition.
(3)The Berlin Commissioner for Data Protection and Freedom of Information shall not be competent for the supervision of the processing of personal data by courts in the context of their judicial activities or by the Court of Auditors in the context of its independent activities. zur Einzelansicht § 8
