Procedure for the Exercise of the Rights of the Data Subject
(1)The controller shall communicate with data subjects in a precise, intelligible and easily accessible form using clear and plain language. Without prejudice to specific formal requirements, and in particular to the requirements pursuant to Section 50(3) sentence 1 no. 8, the controller should, as a rule, use the form chosen for the request when responding to requests.
(2)In the case of requests, the controller shall, without prejudice to Section 43(6) and Section 44(6), inform the data subject without undue delay and in writing of how the request was dealt with.
(3)The provision of information pursuant to Section 41, the notifications pursuant to Sections 42 and 52, and the processing of requests pursuant to Sections 43 and 44 shall be free of charge. In the case of manifestly unfounded or excessive requests pursuant to Sections 43 and 44, the controller may either charge a reasonable fee based on administrative costs or refuse to act on the request. In such case, the controller must be able to demonstrate the manifestly unfounded or excessive nature of the request.
(4)Where the controller has reasonable doubts about the identity of a data subject who has submitted a request pursuant to Section 43 or 44, the controller should request additional information necessary to confirm the identity of the data subject. zur Einzelansicht § 45
