§ 19 BlnDSG

Processing of Personal Data for Purposes

(1)of Freedom of Expression and Freedom of Information
(2)Insofar as personal data are processed in the exercise of the right to freedom of expression and information for journalistic, artistic or literary purposes, including lawful processing on the basis of Sections 22 and 23 of the Act on Copyright in Works of Fine Arts and Photography, as published in the revised version in the Federal Law Gazette Part III, index number 440-3, as last amended by Article 3 Section 31 of the Act of 16 February 2001 (BGBl. I p. 266), only Article 5(1)(f), Article 24 and Article 32 of Chapters II to VII and IX of Regulation (EU) 2016/679 shall apply. Article 82 of Regulation (EU) 2016/679 shall apply with the proviso that liability shall only cover damage arising from a breach of data secrecy or from inadequate technical or organisational measures within the meaning of Article 5(1)(f) of Regulation (EU) 2016/679.
(3)Where the processing of personal data pursuant to paragraph 1 sentence 1 leads to the dissemination of counter-statements of the data subject, or to declarations of commitment, orders or judgments on the prohibition of dissemination or on the retraction of the content of the data, these shall be taken with the stored data and kept there for the same period as the data themselves, and shall be transmitted together with the data upon any transmission. zur Einzelansicht § 19
