Recourse to the Berlin Commissioner
(1)for Data Protection and Freedom of Information
(2)Any data subject may, without prejudice to other legal remedies, lodge a complaint with the Berlin Commissioner for Data Protection and Freedom of Information where they consider that the processing of their personal data by public bodies for the purposes referred to in Section 30 has violated their rights. This shall not apply to the processing of personal data by the courts insofar as they processed the data in the context of their judicial activities. The Berlin Commissioner for Data Protection and Freedom of Information shall inform the data subject of the progress and the outcome of the complaint and shall draw the data subject's attention to the possibility of judicial remedy pursuant to Section 47.
(3)The Berlin Commissioner for Data Protection and Freedom of Information shall, where a complaint lodged with them concerns processing that falls within the competence of a supervisory authority of the Federation, another Land or another Member State of the European Union, forward the complaint without undue delay to the competent supervisory authority. The Commissioner shall in this case inform the data subject of the forwarding and, at the data subject's request, provide further assistance. zur Einzelansicht § 46
