Remote Metering and Remote Control Services
(1)Public bodies may carry out remote measurements or observations (remote metering services) in dwellings or business premises or trigger other effects in dwellings or business premises by means of a transmission device (remote control services) only if the data subject has been informed in advance of the intended use and the type, scope and period of the use of the services and has consented in writing or electronically after being so informed. The data subject may withdraw consent at any time. The deactivation of a service shall, in case of doubt, be deemed a withdrawal of consent.
(2)The installation of remote metering and remote control services shall only be permissible if the data subject can recognise in a reasonable manner when a service is being used and what type of service it is, and if the subscriber can deactivate the service at any time, insofar as this is compatible with the contractual purpose.
(3)A service, the conclusion or performance of a contractual relationship shall not be made conditional on the data subject's consent pursuant to paragraph 1 sentence 1. If consent is refused or withdrawn, no disadvantages shall arise for the data subject beyond the direct consequential costs.
(4)Insofar as personal data are collected in the course of remote metering and remote control services, they may only be processed for the agreed purposes. Articles 7 and 8 of Regulation (EU) 2016/679 shall remain unaffected. zur Einzelansicht § 22 Kapitel 3 Rechte der betroffenen Personen
